Welcome to SpikeLens. By creating an account or using the platform you agree to these terms. Please read them — they're written to be understood, not to obscure anything.
1. Service Terms
SpikeLens is actively developed. Features may change or be updated over time as the product evolves. We don't guarantee uptime, data retention, or continuity of any specific feature. We appreciate your patience as we build — your feedback directly shapes what we ship next.
2. Eligibility
You must be at least 18 years old to use SpikeLens. By signing up, you confirm that you meet this requirement. Each person may only maintain one account.
3. Your Account
You are responsible for keeping your login credentials secure. Don't share your password or allow others to access your account. Please provide accurate information when you sign up — fake or misleading details can result in suspension. If you suspect unauthorized access, contact us immediately.
4. Acceptable Use
SpikeLens is built for personal analysis and education. You agree not to:
- Scrape, mirror, or systematically extract data from the platform
- Redistribute or resell market data obtained through SpikeLens
- Build or operate automated trading systems based solely on AI output from this platform
- Abuse, overload, or attempt to reverse-engineer the service
- Use the platform to provide financial advisory services to third parties
Violation of these rules may result in immediate suspension or termination of your account.
5. AI Disclaimer
Lenzi is not a financial advisor.
Everything Lenzi says is for educational and informational purposes only. Nothing on this platform constitutes financial, investment, or trading advice.
All trading decisions are entirely your responsibility. AI output may contain errors, omissions, or inaccuracies. Past chart patterns do not guarantee future results. Market conditions change rapidly, and technical analysis is inherently probabilistic. Always do your own research and consult a licensed financial professional before making investment decisions.
Marketing statements. Statements made on the SpikeLens website, in advertisements, in onboarding flows, in webinars, in social posts, in demos, in examples, or in similar materials are illustrative descriptions of how the service is designed to work. They are not promises of accuracy, profit, win rate, trading success, or any specific outcome, and they are not financial advice. The binding description of the service is contained in these terms and the Privacy Policy.
6. Intellectual Property
Spike Lens, Inc. owns the platform, its codebase, and underlying technology. You retain full ownership of your conversation data, analysis notes, and any content you create using the platform. We don't claim rights to your work.
License to operate and improve the service. You grant Spike Lens, Inc. a worldwide, royalty-free, non-exclusive license to use, store, process, reproduce, and create derivative works of your prompts, chart context, conversation content, and AI outputs solely to (i) operate, secure, support, and maintain the service for you, (ii) improve the accuracy and quality of Lenzi's analysis, including in anonymized or aggregated form, and (iii) comply with applicable legal obligations. Spike Lens, Inc. does not sell your conversation content and does not use your conversation content to train publicly released AI models.
7. Data & Privacy
How we handle your data is described in our Privacy Policy. By using SpikeLens, you agree to the data practices described there.
8. Disclaimer of Warranties
SpikeLens is provided "as is" and "as available."
We make no warranties, express or implied, regarding the platform's reliability, accuracy, availability, fitness for a particular purpose, or non-infringement. Use SpikeLens at your own risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Spike Lens, Inc. and its operators, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Any trading losses or financial outcomes resulting from use of the platform
- Market data inaccuracies, delays, or gaps
- Service interruptions, outages, or data loss from time to time
- Errors or inaccuracies in AI-generated analysis
- Any financial decisions made based on Lenzi's output
- Loss of profits, data, or business opportunities
Aggregate liability cap.
In no event shall Spike Lens, Inc.'s total aggregate liability to you for any claim arising out of or related to these terms or the service exceed the greater of (i) the total amount you paid to Spike Lens, Inc. in the twelve (12) months preceding the claim, or (ii) USD $100. This cap applies regardless of the legal theory on which the claim is based.
10. Indemnification
You agree to indemnify and hold harmless Spike Lens, Inc., its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your trading decisions, your violation of these terms, or your violation of any third-party rights.
11. Termination
We may suspend or terminate access at any time, for any reason, with or without notice. This includes accounts that violate these terms or are inactive for extended periods. You can delete your account at any time from your account settings.
12. Governing Law
Spike Lens, Inc. is a Delaware corporation with its principal place of business in the United States. These terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
13. Dispute Resolution
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@spikelensai.com. We'll try to resolve the issue within 30 days. If we can't reach a resolution, either party may proceed with legal action in the jurisdiction specified above.
14. Changes to Terms
We may update these terms from time to time. When we do, we'll update the effective date at the top of this page. For significant changes, we'll notify you by email. Continued use of SpikeLens after changes are posted constitutes your acceptance of the updated terms.
15. General Provisions
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These terms constitute the entire agreement between you and Spike Lens, Inc. regarding the use of the platform and supersede any prior agreements. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
16. Billing, Pricing & Service Changes
Billing & auto-renewal. Paid subscriptions are billed in advance on a recurring basis through our payment processor (Stripe). Monthly subscriptions are billed each month and renew monthly at the then-current price unless canceled. Annual subscriptions are billed in advance for twelve months and renew annually at the then-current price unless canceled before the renewal date. You can cancel at any time from the customer portal and retain access until the end of the paid period; canceling stops future renewals but does not by itself delete your account.
Free trials. Some plans or promotions may be offered with a free trial period. If a trial requires a payment method, your subscription will automatically convert to a paid subscription at the end of the trial and your payment method will be charged for the first billing period, unless you cancel before the trial ends. Where reasonably possible, we will send a reminder email before a trial converts; we do not guarantee that any specific reminder will be delivered. You can cancel a trial at any time from the customer portal.
Promotional codes. From time to time we offer promotional codes — for example, community discounts, webinar codes, partner discounts, or limited-time offers. Unless stated otherwise at the time of redemption, each promotional code: (i) is valid for one redemption per user, (ii) may apply only to specific plans, specific billing periods, or the first invoice of a new subscription, (iii) cannot be exchanged for cash, (iv) cannot necessarily be combined with other promotional offers, and (v) may expire on the date shown at the time of redemption. We may change, limit, suspend, or cancel promotional codes at any time, including in cases of suspected abuse, fraud, or error.
Refunds. Subscription payments are non-refundable except where required by law. Canceling your subscription stops future renewals — it does not trigger a prorated refund for the current billing period, and you keep access until that period ends. If you believe you've been billed in error, contact support@spikelensai.com within 30 days of the charge and we'll review the request. See Section 17 for how subscriptions and refunds are handled if Spike Lens, Inc. permanently discontinues the service.
Suspension for non-payment. If a subscription payment fails, our payment processor will attempt to recover the payment through automated retries. During this recovery window your paid access may be restricted or downgraded to the free plan after a short grace period. If recovery ultimately fails, the subscription is canceled and your account moves to the free plan; your conversation history and data remain intact and paid features resume if you start a new paid subscription.
Chargebacks & billing disputes. If you have a billing concern, please contact support@spikelensai.com before initiating a chargeback or dispute with your bank or card issuer, so we can attempt to resolve the issue directly within 30 days (see Section 13). We may suspend or restrict access to the service during a billing dispute.
Taxes. Listed prices may be exclusive of any applicable taxes (such as VAT, GST, or sales tax). Where applicable taxes are calculated and added at checkout, they will appear in your invoice from our payment processor. You are responsible for any tax obligations that apply to your use of the service in your jurisdiction that are not collected at checkout.
Pricing changes. We reserve the right to change pricing, subscription plans, or billing terms at any time. Any changes will take effect on your next billing cycle, and we'll notify you by email before they apply.
Scheduled maintenance. We may perform scheduled maintenance or updates that temporarily interrupt the service. We'll try to schedule significant downtime outside US market hours when practical.
Events beyond our control. We are not responsible for service interruptions caused by events outside our control, including internet outages, cloud or infrastructure provider failures, natural disasters, or third-party service disruptions (market-data providers, authentication providers, payment processors, or AI model providers).
Feature changes. We may modify, suspend, or discontinue any part of the service at any time, with or without notice, and without liability. Features available today are not guaranteed to remain available, and new features are not guaranteed to be included in any existing plan.
17. Service Discontinuation
Discontinuation right. Spike Lens, Inc. may discontinue the service, in whole or in part, at any time. If Spike Lens, Inc. decides to permanently shut down the paid service or wind down the company, Spike Lens, Inc. will use commercially reasonable efforts to notify active paying users by email at least fourteen (14) days before the shutdown date and to keep export of conversation history available during that window.
Effect on subscriptions. Upon a permanent shutdown, all active subscriptions will be canceled. Refunds for unused paid time are not guaranteed and are subject to Sections 9 (Limitation of Liability), 16 (Billing, Pricing & Service Changes), and applicable law. If Spike Lens, Inc. chooses to issue refunds, they will be pro-rated for the unused portion of the then-current billing period only and will be paid through the original payment method.
Insolvency. Nothing in these terms requires Spike Lens, Inc. to operate the service beyond its ability to do so or to issue refunds in the event of insolvency, bankruptcy, or dissolution. In those events, refund claims are limited to what is permitted by applicable law and by the liability cap in Section 9.
Assignment & change of control. Spike Lens, Inc. may assign or transfer this agreement, in whole or in part, to a successor in connection with a merger, acquisition, sale of assets, financing, reorganization, or by operation of law. You may not assign your rights under this agreement without prior written consent from Spike Lens, Inc. Following any assignment, references to "Spike Lens, Inc." mean the successor entity, and your access continues under these terms unless and until the successor changes them in writing.
Survival. Sections 4 (Acceptable Use, for breaches occurring before termination), 5 (AI Disclaimer), 6 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), 13 (Dispute Resolution), 15 (General Provisions), 16 (Billing, Pricing & Service Changes), and this Section 17 survive any termination or discontinuation of the service.
